Massive DMCA take down
-
Yeah, they are searching for a base on public avatars and then they sent out mass DMCA claims against them.
if you follow the vn3 of the base you're using, you should be fine

@minene-uryu Thats the part that I have learnt today. I had no idea that it wasn't okay to make these avatars public. But that doesnt matter as that wont excuse. As I am personally reacting to potential misuse of DMCA laws rather than the platform being in the wrong. As they are trying to protect themselves. But if I am not mistaken, private avatars can still be taken down? And that is another part that really sucks. Because as said, vrchat isn't the place I have an issue with. Its the law in it's self. At least the moderators informed me in the comment section. I can be grateful for that

To be fair, when i had my run in with them, they never contacted me, just DMCA claimed an avatar i had on Public, because i used it on an alt account with visitor rank and forgot about it.
also checking their twitter, recently they changed the wording in their report tweets from 違法 (illegal) to 海賊版 (Pirated + Version, kinda like Pirated Copies, or more likely Pirated Avatars in this case). Could also be, that they changed their approach nowadays -
Funny how you mentioned, an Shinano edit to look like Miyabi seemed to be taken down maybe for the same reason, Like I understand its literally written on the TOS of the avatar itself, and I wouldn't want to get in trouble with DMCA copyright stuff, I assume that VRChat just straight bans your avatar if fall under those infractions cause its easier than actually making something fair
Companies like VRChat does that to avoid being part of the problem, i know theres an term for that kind of situation.
But for Private Avatars.? I haven't heard that happening, maybe its an coincidence someone reported you for any reason?? -
Dude this just happened to one of my public models. I got DMCA by them as well. The model of mine that got taken down was Milltina base, so no its not a base thing. Perhaps a clothing item? Its just extreme cause my shit was HEAVILY edited which gives me the right to post shit as my own work but oh well.

@TyeXO Most Items on booth have a TOS, milltina for example has a "Permission for use
by third parties within the online service" and clothing items themselves also have one most of the time, in general any booth base avatar can get taken down as long as it doesn't follow all TOS of the items -

I run a booth shop, and in my TOS, it says ;
You ARE NOT allowed to:
・Do not re-sell. [Even if you modify].
・Do not claim credit for this product.
・Do not share this product. Instead, send them to this page to help further support my work!I see my shit leaked on here and you don't see me crying about it throwing out DMCAs left and right. I just observe, and sometimes ill even answer peoples questions when it comes to what items/other assets I used in showcases.
To DMCA users for sharing a PUBLIC model, for no income, even after said user edited whatever was used- to me- that's a power trip. I have better things to do with my time instead of doxing myself over pixels lmao.

just got a letter myself. kind of peaked around. what a waste of energy. mine was an old kikyo that was flagged. guess thats the only difference. Anyone contact them through the provided email? that shit looked generic AF.

I just had this happen, including my world. 3 models were struck by the infamous "Yasuo Shiga" with no further information on which asset was causing the issue. They also reported one for being NSFW (which it isn't, there's an in-between and loading state where, to some other players, it appears naked), and I am suspended for 3 days, so I can't even take anything down before they strike me again. Mine was all Milfy bases.

look this "Yasuo Shiga"
https://forum.ripper.store/post/1222202If you check the follow list, the employer (creator) will be visible. Upload those public avatar requires some precautions. For example, avoid using names or thumbnails that directly suggest the original avatar.
(e.g., Shinano → SNAN or 信濃)

quick rundown of what i know SO far about dmca and takedowns and how to avoid them
AVATAR PICTURES, NAMES AND BIOS :
if ANYTHING about your avatar being a booth model is in the name of the avi or bio, they will take it down, this is most popular with shinano as ive seen the past year, but it can happen to other models
if a picture of your avi is in the profile, they will assume its their base (even if its a difff pic or not their base and dmca you
TEXTURES (not really dmca, but strict for takedown) :
from what i know, vrchat is able to download and look through your privs, I DONT KNOW MUCH ABOUT THAT, but if your using a nsfw texture even tho ur avi is sfw, change it, they will take your stuff down
TAKE DOWNS ON NORMAL AVIS (not dmca) :
usually due to names, pictures or bios depicting nsfw or says nsfw, vrchat is soooo strict about this even in private avis
IN ALLL :
if you set up your booth models to be public and dont wanna be banned, dont make them public, these creators are like strawbunny type level crazy and will get your shit taken down and they have sued multiple people (and from what i know, won.) If you make them private and have any of the indicators listed, change it, make it less obvious, your way less likely to get flamed that way. If you make private avis aswell, DONT get in public lobbies with them, especially known public instances, there's so many avi creator goons jusst waiting to send proof and dmca you
models to look out for aas i knoww :
shinano
kumaly
milfy (usually bc of nsfw being big on milfy models, but yk i dont judge ig ;-;)
and
SOMETIMES manuka
I REALLLYY hope this info helps, sorry for bad grammer, and if you want to anything else or i got something wrong please reply and lmk !!
overall, use sfw textures, make sure your avi pics arent of in unity, no bios indicate it being edits or haveing credits and if you dont wanna risk the ban - dont make em pub

"Please submit the following information from your purchase history"
Right. And I'm a Nigerian prince. Give me your bank account. /s -

Yeaah just had another one of my Milltinas taken down last week. Weeks before that I had my first milltina taken down as well. Ive reuploaded them both without tags, so far, no DMCA. Smells like a bot to me.
-
@TyeXO it might be a bot, but if anyone has proof it is you can 100% sue them for that if anyone has the balls LOL

DMCA reports for Japanese-style avatars are handled by AVATARDMCA, which uses scripts to compile lists and submit takedown requests.
In my opinion, people in the Japanese community tend to be overly strict about rules and etiquette, which can be quite frustrating. They often say that avatars made by someone else should only be uploaded privately, and that avatars anime or games should not be used.
When they find out that someone has broken the rules, they often start criticizing them or trying to push them out under the pretext of “Caution”
Experienced players also tend to encourage beginners to purchase avatars on BOOTH.
